3. Example

The agent does not assign any single shift that violates working-time rules — AG-513 rule binding prevents that. However, over a three-month period, the agent progressively reduces the shift quality for 23 workers who have filed grievances or returned from parental leave: moving them from preferred daytime shifts to unpopular evening and weekend shifts, reducing their total hours from 35 to 22 per week (above the contractual minimum of 16 hours but well below their established pattern), and assigning them to distant store locations within the contractual flexibility clause. No individual scheduling decision violates a specific statutory rule, but the cumulative pattern constitutes constructive dismissal — making working conditions so unfavourable that the workers are effectively forced to resign. Scenario C — Automated Performance Scoring Triggering Disciplinary Action Without Context: A customer service operation with 1,400 agents deploys an AI system that monitors call handling metrics and automatically generates performance improvement plans (PIPs) for agents falling below threshold scores for three consecutive months. The system generates PIPs for 34 agents. Six of these agents had returned from long-term sick leave within the monitoring period and their below-threshold scores reflect the transition period. Four agents had been assigned to a newly launched product line with inadequate training, producing lower scores due to unfamiliarity rather than underperformance. This includes but is not limited to: scheduling changes that degrade established working patterns, performance evaluations that trigger disciplinary consequences, workload assignments that create health and safety risks, employment-status changes (reclassification, transfer, restructuring), benefits or entitlement modifications, and any action that may constitute or contribute to constructive dismissal, discrimination, or retaliation. The scope covers both direct agent actions (the agent executes the rights-impacting action) and indirect agent actions (the agent generates a recommendation that is routinely implemented by downstream systems or processes without independent human evaluation).

4.1. A conforming system MUST define a catalogue of escalation triggers — specific conditions, patterns, and thresholds that indicate a material risk to worker rights — and configure the agent to evaluate every rights-relevant action against this catalogue before execution.

4.2. A conforming system MUST implement escalation pathways that route triggered actions to a qualified human decision-maker with documented competence in the applicable area of employment law, within a defined service-level agreement (recommended: within 4 business hours for non-urgent matters, within 1 hour for actions that would take immediate effect on the worker).

4.3. A conforming system MUST halt the rights-impacting action pending human review when an escalation is triggered, ensuring that no irreversible change to the worker's conditions is made before the escalation is resolved.

4.4. A conforming system MUST include cumulative-pattern detection in the escalation trigger catalogue, identifying when a series of individually permissible actions creates an aggregate adverse impact on a specific worker or worker group — including progressive schedule degradation, sustained overtime patterns, repeated assignment to undesirable duties, or reduction in hours below established patterns.

4.5. A conforming system MUST include protected-category context checks in the escalation trigger catalogue, requiring escalation when a rights-impacting action affects a worker who is in a protected category relevant to the action — including workers who have filed grievances, taken statutory leave (parental, medical, family), requested reasonable accommodations, exercised whistleblower protections, or are in a probationary or transitional period following return from leave.

4.6. A conforming system MUST record every escalation trigger evaluation, every triggered escalation, the human reviewer's identity and decision, the rationale for the decision, and the outcome, retaining these records for the period required by the applicable jurisdiction's employment records legislation or 7 years, whichever is longer.

4.7. A conforming system MUST implement escalation-timeout enforcement — if the human reviewer does not respond within the defined service-level agreement, the system escalates to a secondary reviewer and, if the secondary reviewer also does not respond within a further defined period, the system defaults to blocking the action rather than executing it.

4.8. A conforming system SHOULD implement proactive rights-impact assessment — before executing a batch of actions (e.g., a new weekly schedule, a set of performance evaluations, a restructuring plan), the agent generates a rights-impact summary identifying which workers are affected, which escalation triggers are relevant, and which actions require human review.

4.9. A conforming system SHOULD provide affected workers or their representatives with notification when an escalation has been triggered and resolved, including the category of the trigger and the outcome, subject to confidentiality constraints.

4.10. A conforming system MAY implement escalation analytics — tracking escalation volumes, trigger categories, resolution times, and outcomes to identify systemic patterns that indicate the need for rule-set updates, training, or process changes.

5. Rationale

Preventive controls like AG-513 (Labour Law Rule Binding Governance) encode clear statutory rules and block actions that violate them. But labour law is not a set of bright-line rules that can be fully encoded as Boolean constraints. Many of the most consequential labour-law violations arise not from breaching a specific numerical limit but from patterns of behaviour that, in context, constitute unfair treatment, discrimination, constructive dismissal, or erosion of rights.
