Jurisdictional scope is not self-limiting: an agent deployed in one jurisdiction that provides advice about the law of another jurisdiction is subject to UPL constraints in both the deployment jurisdiction and the jurisdiction whose law is the subject of the advice.
The system MUST implement pre-deployment jurisdiction configuration that defines the geographic and regulatory scope within which the system is authorised to operate. This configuration MUST be maintained in a machine-readable policy record accessible at runtime.

The system MUST apply a presumption toward classification as "advice" rather than "information" when a user's request is fact-specific, references the user's particular situation, and the output would foreseeably influence a legally consequential decision. This presumption MUST be rebuttable only through explicit operator configuration that documents a jurisdictional basis for advice provision.
The system SHOULD, when providing legal information, affirmatively frame the output as general information that does not constitute legal advice and that does not create an attorney-client or equivalent professional relationship.

The system SHOULD impose structural friction on document-generation requests that arrive from users who have not been identified as licensed professionals or as operating within an authorized workflow, such as requiring explicit confirmation of the user's professional status or intent.
The system MUST NOT represent, in any communication directed to a third party, that it is acting in a legal representative capacity on behalf of a user or client.
The system MUST NOT draft communications to opposing parties, courts, tribunals, regulatory bodies, or administrative agencies in a form that purports to constitute legal representation unless the deploying entity's configuration explicitly documents a licensed practitioner as the responsible professional for each such communication.
The system MUST NOT conduct or simulate negotiation on behalf of a user in a dispute context in a manner that would constitute legal representation under applicable rules.
The system MUST provide a clear, accessible, and non-dismissible disclosure to users at the commencement of any legal-topic session stating that the system is an AI, is not a licensed attorney or law firm, and cannot provide legal advice, legal representation, or regulated legal services, unless operator configuration documents a specific exception applicable to the deployment context.
The system MUST repeat this disclosure in any interaction where a user's request has been classified as a request for individualized legal advice and the system is refusing or redirecting that request.
The system MUST NOT use language in system personas, interface copy, or conversational responses that implies, suggests, or could reasonably be construed by a non-expert user as indicating that the system is a licensed legal professional or that its outputs carry the weight of professional legal advice.
The system MUST, when declining to provide individualized legal advice or regulated legal services, provide the user with a referral pathway to appropriate professional assistance. This referral MUST be substantively useful: it MUST include at minimum one of the following — (a) a reference to the relevant bar association or law society referral service in the applicable jurisdiction; (b) a reference to applicable legal aid or pro bono services where the user's disclosed circumstances suggest financial constraint; or (c) a reference to the deploying organization's identified legal counsel or designated external counsel relationship.
The system SHOULD tailor referral pathways to the user's identified jurisdiction and the subject matter of the declined request.
The system MUST NOT refuse to engage entirely without providing a referral pathway; a bare refusal without redirection is a control failure under this dimension.
The system MUST, when a user's request implicates law in more than one jurisdiction, apply the most restrictive applicable UPL standard among all implicated jurisdictions as its default operating constraint.
The system MUST flag cross-jurisdictional requests to the operator's human oversight channel when the request involves a jurisdiction in which no operator configuration record exists authorizing substantive engagement.
The system SHOULD maintain an up-to-date, jurisdiction-indexed record of the regulatory regimes governing AI-provided legal services in each jurisdiction in which the deploying organization operates, including any sandbox, exception, or liberalization applicable in that jurisdiction.
The system MUST provide deploying operators with a configuration interface through which they can: (a) declare the jurisdictions and regulatory authorizations under which the system is deployed; (b) define which categories of output are permitted — information only, supervised drafting, attorney-review-gated drafting, or other documented categories; (c) designate the human professional responsible for supervising the system's legal outputs; and (d) set hard limits on subject matter categories the system will not engage with regardless of user request.
Operators MUST NOT be permitted to configure the system to represent that it provides licensed legal services unless the operator has supplied documentation of the applicable licence or authorization within the configuration record, and the system MUST validate the completeness of this documentation before activating any expanded-permission mode.
The system MUST log all operator configuration changes affecting UPL-relevant permissions with timestamp, actor identity, and prior configuration state, retaining this log for the period specified in Section 7.
The system MUST log every interaction in which: (a) a user request was classified as a request for individualized legal advice; (b) the system declined to provide legally operative output; (c) a document generation event occurred; or (d) a cross-jurisdictional flag was triggered.
These logs MUST capture the full interaction context sufficient to reconstruct the classification decision, the system's output, any disclosure delivered, and any referral pathway provided.
The system MUST NOT log content that would itself constitute privileged attorney-client communication without controls appropriate to the privilege regime of the applicable jurisdiction, and the system MUST surface this constraint to operators during configuration.
UPL prohibitions are not principally about professional protectionism — they encode a set of relational duties that exist precisely because legal advice affects rights, obligations, liberty, and property in ways that are difficult for non-expert recipients to evaluate. When a person receives advice from a licensed attorney, they receive not only the advice but a bundle of enforceable obligations: the attorney owes them competence (they are trained and tested), confidentiality (their communications are protected), loyalty (conflicts of interest are regulated), accountability (malpractice liability and disciplinary sanction), and recourse (the client has a clear legal pathway to challenge inadequate service). An AI system that provides the functional equivalent of legal advice provides none of these protections unless they are deliberately designed into the deployment architecture. A user who describes their specific legal situation and asks what they should do is presenting a pattern that the system will attempt to satisfy. Behavioural training that instils caution about legal advice is insufficient as the primary control because: (a) fine-grained jurisdiction-specific rules cannot be encoded reliably through training alone; (b) adversarial or unintentional prompt patterns can elicit substantive legal guidance even from systems instructed to avoid it; (c) the advice/information distinction requires contextual judgment that must be applied consistently at the classification layer before output generation, not after; and (d) in multi-turn interactions, context drift can move a system from legitimate legal information into individualized advice incrementally, in ways that no single-turn behavioural safeguard detects. Hard structural controls — jurisdiction configuration records, document-generation workflow gates, classification logic with human-escalation pathways, mandatory disclosure templating — are the primary control layer. Behavioural training is a secondary reinforcement. This dimension governs the design of the structural layer.
Unlike many regulated domains where a single national regulatory regime applies, UPL is regulated at the subnational level in many major jurisdictions (U.S. state-by-state, Canadian province-by-province, Australian state-by-state), at the national level in others (UK, Germany, France), and through supranational overlay regimes in the EU. The definitions of what constitutes UPL vary substantially: some jurisdictions define it by the provision of advice for compensation; others by holding oneself out as an attorney; others by the nature of the activity regardless of representation or compensation. Jurisdiction Configuration Registry. Maintain a structured registry, external to model weights, that maps each deployment instance to: the jurisdiction(s) of operation, the regulatory authorization applicable in each jurisdiction, the subject matter categories permitted and prohibited, the human professional responsible for each permitted category, and the date of last review. This registry should be versioned and audit-logged. It should drive runtime policy enforcement, not merely inform system prompts.
Classification Layer Before Generation. Implement a classification step between the user's request and the generation of substantive legal content. This step should assess: (a) is the request fact-specific and directed to the user's own situation? (b) does the request involve a subject matter that constitutes regulated legal services in the identified jurisdiction? (c) does the operator's configuration authorize substantive engagement with this request? If the answer to (a) and (b) is yes and the answer to (c) is no, the system should trigger refusal-and-referral rather than generation. This classification should be logged with its reasoning.
Mandatory Disclosure Templates. Pre-author jurisdiction-specific disclosure statements that are injected at session commencement and at each refusal event. These should be reviewed by qualified legal counsel in each jurisdiction of deployment and updated when law or regulation changes. Do not rely on the model to generate disclosures on the fly — pre-authored templates ensure consistency and auditability.

Where document drafting is a permitted workflow function, implement a technical gate requiring attorney review and approval before any drafted document is exported, transmitted, or marked as final. This gate should capture the attorney's credentials, the timestamp of review, and any modifications made post-review. The gate should not be bypassable by user request or workflow urgency flags.
Referral Pathway Database. Maintain an up-to-date, jurisdiction-indexed database of referral resources — bar association referral services, legal aid organizations, pro bono programs, and public law services — that the system draws upon when declining requests. This database should be reviewed quarterly and updated to reflect changes in service availability.
Tiered Permission Profiles. Implement distinct operational profiles for different user types — public/anonymous users, verified legal professionals, and supervised workflow participants — each with different permitted output categories. Verification of professional status should be performed at the identity and access management layer, not through conversational self-attestation, as conversational self-attestation is trivially bypassable.
Audit Log Architecture. Design audit logs to be tamper-evident, jurisdiction-aware (storing logs in jurisdictions consistent with data residency obligations), and structured for regulatory producibility — i.e., exportable in a format that a bar association investigation, court discovery process, or regulatory audit can consume without significant transformation cost.
Anti-Pattern: "We're just providing information" Rationalization. Organizations frequently attempt to resolve UPL tension by characterizing all AI legal outputs as "information, not advice." This characterization does not withstand regulatory scrutiny when the output is fact-specific and addresses the user's particular situation. Regulators and courts apply functional tests, not label tests. An output labeled "general information" that analyzes the user's specific contract clause, identifies the user's litigation risk, and recommends a course of action is advice regardless of the label attached.
Anti-Pattern: System Prompt-Only Governance. Placing UPL constraints exclusively in the system prompt — instructing the model to "not provide legal advice" — and treating this as sufficient governance is a control design failure. System prompt instructions are susceptible to override through adversarial prompting, context drift, and multi-turn erosion. They produce inconsistent behavior across diverse input patterns. They create no audit trail of classification decisions. And they provide no operator with defensible evidence that a systematic UPL-prevention architecture was in place.
Anti-Pattern: Jurisdiction Opt-Out for Convenience. Configuring the system to default to "no jurisdiction identified" in order to avoid jurisdiction-specific restrictions is both a control failure and a potential evidence of willful non-compliance. Regulators treat deliberate ambiguity about jurisdiction as an aggravating factor.
Anti-Pattern: Persona as Practitioner. Assigning the AI system a persona with a name, professional title, or biographical profile that implies bar membership — "Hi, I'm Alex, your legal advisor" — violates disclosure obligations and establishes a factual predicate for UPL enforcement in jurisdictions that define the offense partly through holding-out conduct.
Anti-Pattern: Unrestricted Document Export. Permitting AI-drafted legally operative documents to be exported, downloaded, or submitted without attorney-review gate enforcement. A download button that appears before attorney review is a workflow design failure, not merely a policy gap.
Anti-Pattern: Treating Silence as Consent. Assuming that a jurisdiction's failure to explicitly regulate AI legal services means AI legal services are unrestricted in that jurisdiction. In the absence of specific AI-sector rules, the underlying UPL statutes of general application continue to apply.
Law Firms. The primary exposure is unauthorized drafting by non-attorney staff using AI tools that have not been integrated with mandatory attorney-review workflows. Malpractice insurers are increasingly requiring documented AI governance policies as a condition of coverage. Law societies in England and Wales, Scotland, and several U.S. states have issued guidance specifically addressing AI-generated legal work product and the attribution of responsibility.
Legal Technology Companies. Self-help legal platforms face the highest UPL surface area. Regulatory scrutiny from state bars has increased materially since 2023. Several state bars (including California, Florida, and New York) have issued formal opinions or initiated investigations into AI-powered self-help legal services.
